$2.3M Negligent Security Settlement

Bennett Legal recently settled a negligent security case against a local Dallas apartment complex for $2,300,000.00.

On August 6, 2020, our client was shot twice, once in the stomach and once in the leg, following an apparent drive by shooting in the complex. Luckily she lived but has permanent injuries from the shooting.

In the 5 years prior to this shooting, there had been numerous reports of serious violent criminal activity at the complex, including person on person crime, property crimes, crimes involving trespassers gaining unauthorized access to the complex, and other abatable criminal activity as defined by Texas Civil Practice and Remedies Code section 125.0015.

In the lawsuit, Bennett Legal alleged that the violent criminal activity on the property was so pervasive and consistent that the property violated Dallas City Ordinance Chapter 27, Article VIII, Section 27-45(a), which requires minimum property conditions and lawful operations for property owners and operators. We alleged that the property was a habitual criminal property and public nuisance. The city ordinance is designed to protect “the health, safety, and welfare of the people of the city of Dallas.”
